BRIX APP (incorporated in Quebec as 9486-3735 Québec Inc.., a subsidiary of Coffrages Synergy) together with its affiliates, subsidiaries, and related entities (collectively, "Brix", "we"", us and "our") are committed to the protection of your privacy. This privacy policy (the "Policy" explains why and how we collect, use, share, store, transfer, and protect (collectively, "Processing", Process and any conjugated form thereof) your Personal Information, as more fully described under the section "About this Policy". The way we Process your Personnal Information   may evolve over time, and we will update this Policy from time to time to reflect any changing practices, as explained below.

Brix App is an online platform created by Brix that allows users to collaborate, receive, and share information at work. The Brix App platform includes the Brix App mobile application that you can download and install on your mobile phone (the "App"), desktop application accessed through a browser, connections to third-party applications and the Brix App APIs, and related services together the "Service or Services".

The Service is intended for use by organizations in accordance with their instructions and is provided to you by your employer or other organization (the "Organization") that has authorized your access to, and use of, the Service.

"You", "Your" or "User" means a user of the Site or Service, which could refer to an individual, an employer, an employee associated with an Organization account, or any other authorized user of the Service.

1. About this Policy

This Policy explains why and how Brix Processes Personal Information in connection with the Service and when you visit our website https://brixapp.io/ (the "Site"). This Policy also describes why and how we Process your Personal Information on behalf of the Organization, for example, when we Process your Personal Information to provide your pay stub or work assignments. This Policy also explains how we use Cookies in the Service and on the Site. For more information, please refer to the section “How does Brix use Cookies?”

2. What is “Personal Information”?

In this Policy, “Personal Information” means any information about an individual that, when used on its own or with other information, allows an individual to be identified. In general, Personal Information does not include business contact information, such as your name, title, business address, or business telephone number.

3. What Personal Information Do We Collect?

We collect your Personal Information when you use our Service and on our Site. Depending on the applicable situation, we will either Process your Personal Information for and on behalf of the Organization or for our business purposes as specified below. Personal Information we collect consists of Personal Information you provided voluntarily to the Organization as part of your agreement with them (employment contract, service contract, or other agreement), or when you visit our Site.
  • Site Visitors
    • Your contact information collected on our Site when you fill out the contact form (e.g., your name, surname, address, email and phone number, username and passwords of your account, if any and any other contact information). Contact information collected on the Site is to correspond with you.
    • Automatically collected data about your computer or mobile device, including non-personal information such as your operating system and browser type, internet service provider (ISP), and Personal Information such as your IP address, browsing history on our Site, as well as referring and exit pages (the pages you clicked to reach our Site and the pages you clicked from our Site), how often you visit or use the Site, which pages you visit and when, which website, ad or email messages were presented to you and any information regarding your viewing history on our Site.   • Brix App Service Users
    • Your contact information, collected on the Service (e.g., your name, surname, address, email and phone number, username and passwords of your account, if any and any other contact information);
    • Your date of birth
    • Your gender or preferred pronoun;
    • Your work information, such as your vacation dates, your schedule, your absences from work and other information related to your work with the Organization;
    • Your financial information, such as your pay stub or any information provided to you by your Organization that is necessary to file your income taxes;
    • Your union
    • Your certificates and licenses that are necessary for you to work with your Organization;
    • The content, communications, and other information that you provide when you use the Service , including when you sign up for an account, create or share content, and messages or communicate with others. This can include information in or about the content that you provide (e.g. metadata), such as the location of a photo or the date a file was created;
    • All communications with other users of the Service;
    • Billing information;
    • Information that you provide when you or your Organization contact or engage support regarding the Service;
    • Your geolocation. When you use specific functionalities in our App, you may be asked to share your mobile device’s precise (GPS) geo-location information. Such geo-location information may include physical locations visited (latitude & longitude). Whether or not we collect this geo-location data is entirely determined by your Organization in their sole discretion. If you do not wish to allow the collection of your precise location, you will be able to turn off such data collection at any time by accessing the privacy settings of your mobile device and/or adjusting the permissions for the App. Please note, however, that some of the App’s features may not work properly if you turn this off, and we are not responsible for any implication of turning off such geo-location tracking.
    • Automatically collected data about your computer or mobile device, including non-Personal Information such as your operating system and browser type, internet service provider (ISP), and Personal Information such as your IP address, browsing history on our site, as well as referring and exit pages (the pages you clicked to reach our site and the pages you clicked from our site), how often you visit or use the Site, which pages you visit and when, which website, ad or email messages were presented to you and any information regarding your viewing history on our Site. 4. How Do We Collect Your Personal Information?

    We collect Personal Information that is provided or generated by your Organization when it provides you with the Services, including when the Organization uses the Service, and when you have provided consent to such a collection by Brix to your Organization.

5. Why Do We Collect Your Personal Information?

  • For specific and limited purposes:

    Brix collects your Personal Information for specific and limited purposes:

    • To provide you access to the Site and Service, to respond to your (or your Organization) inquiries and requests, and to contact and communicate with you;
    • To prevent fraud with, protect the security of, and address any problems with the Site and Service;
    • To provide you with informational newsletters, and promotional materials relating to our Service, including via email (the “Messages”). You may unsubscribe to stop receiving the materials;
    • To create your profile as a User
    • For the Organization to communicate with you and send you messages within the application or by text. When the Organization sends you push notifications on your mobile phone, you may opt out by changing your phone settings;
    • To support your Organization in meeting its legal obligations.
  • For Secondary Purposes:

    Brix may also aggregate and anonymize Personal Information that you have provided to create statistical data, such statistical data has been anonymized so that individuals cannot be identified. Brix may use statistical data in order to:

    • To improve the Site and Service
    • examine trends and interests, train machine learning algorithms, or share with its third-party partners.

This statistical data does not include Personal Information about Users.

6. Who Do We Share Your Personal Information With?

Brix does not rent nor sell any of your Personal Information to third parties and will not share it with third parties without your consent unless it is necessary to do so by law or for the purposes as set forth below.

  • With the Organization
    • Brix shares your Personal Information with the Organization with whom your account is associated with. This includes, but not limited to, when we are requested to share Personal Information regarding your usage of Service, your communication, IP address, or geo-location (which you have consented to provide) that we have collected. Other users of your Organization account may have access to some of your Personal Information depending on the settings within the account set by your Organization.
  • With Brix Employees
    • In the course of their work, our employees may need to access your Personal Information, for example, when you contact us or request support. Their access is limited to what is necessary to perform their duties.
  • With Third Party Agents and Service Providers
    • Brix may use third parties to facilitate its business and to assist us in making available all of the features of our Site and Service, or for providing customer support services, such as mobile phone services provider (SMS), customer relationship management platform providers, payment processors, hosting service providers. In connection with these business operations, Brix’s service providers may have access to your Personal Information for use for a limited time in connection with these business activities. Where Brix utilizes third parties for the Processing of any Personal Information, Brix implements reasonable contractual and technical protections in order for such third parties to keep all Personal Information they Process strictly confidential. Please note that these third parties may be located elsewhere than your location in which case, appropriate measures are taken by Brix as set forth below in the section “Where is your Personal Information stored and transferred?”.
  • When Required by Applicable Laws
    • Brix may also share your Personal Information if required to do so by law or in the good faith belief that such action is necessary to: (i) conform with the law; (ii) comply with the order of a competent judicial authority in any jurisdiction; (iii) comply with legal process served on Brix; (iv) protect and defend the rights or property of Brix; (v) enforce or verify your compliance with any part of the agreements that you have entered into with Brix, if any; (vi) prevent fraud or other illegal activity perpetrated through the Service; or (vii) act in urgent circumstances to protect the personal safety of users of the Service, the Site or the public at large.
  • During Business Transfers
    • We may share your Personal Information without your permission when our operations require it (in the event of a merger, acquisition, bankruptcy, or sale of assets, for example). As part of this kind of event, we may also share some or all of your Personal Information to the relevant third party (or its advisors) as part of a due diligence process.
  • For Other Purposes With Your Consent
    • For other purposes not specified above, Brix will ensure that it obtains your consent before sharing your personal information.

7. How Long Will We Keep Your Personal Information?

Brix will retain your Personal Information only for as long as necessary to fulfill the purposes for which it was collected, or as instructed by Organization, or to comply with applicable legal, tax or regulatory requirements. After such time, any Personal Information held by Brix will be destroyed, deleted, or made anonymous. 8. How Do We Protect Your Personal Information?

  • With necessary and appropriate security measures

    We have implemented and maintain appropriate technical and organization security measures, policies and procedures designed to reduce the risk of accidental destruction or loss, or the unauthorized disclosure or access to Personal Information appropriate to the nature of such data. The measures we take include:

    • Safeguards – The physical, electronic, and procedural safeguards we employ to protect your Personal Information includes secure servers, firewalls, antivirus, and SSL encryption of data.
    • Access Control – We strictly manage system entries and restrict access to your Personal Information to authorized personnel only on the basis of their need to have access to your Personal Information in the course of their duties. We maintain an up-to-date list of persons authorized to access your Personal Information, which is reviewed at
    • Internal Policies – We maintain and regularly review and update our privacy-related and information security policies.;

  • Non-disclosure agreement – We require new employees of ours to sign non-disclosure agreements according to applicable law and industry customary practice.
  • Encryption – We encrypt the data in transit using secure TLS/ SSL protocols.

While we strive to use the most secure and appropriate measures to protect your Personal Information, we cannot guarantee that our Site and Service will be free from malfunction, unlawful interception or access, hacking attempts, cyber-attacks or any other type of abuse or misuse.

Since the security of your information depends in part on the security of the computer you use to communicate with us and the security you use to protect your IDs and passwords, please take appropriate measures to protect your information.

If you believe that an unauthorized account has been created using your name, or that unauthorized access has been made to your account, please notify us as soon as possible as indicated in the “How to contact us ?”   section.

9. Children’s Privacy

Brix does not target minors, and more specifically, Brix does not intentionally obtain Personal Information from minors. However, if the Organization has users who are minors, it is the Organization's responsibility to obtain the required parental or guardian consent in accordance with the laws and regulations in effect in the user's region.

10. How Do We Use Cookies?

A cookie is a small text file that is stored in a dedicated location on your computer, mobile device, tablet, or other device when you use your browser to visit an online service. Other tracking technologies, such as web beacons and tracking pixels may be used for similar purposes. In this Policy, all of these tracking technologies are collectively referred to as “Cookies”. Any Personal Information collected with Cookies by Brix or on its behalf is treated with the same level of confidentiality as any other Personal Information held by Brix.

  • Strictly Necessary Cookies

    These Cookies are necessary for the Site and Service to function and cannot be switched off in our systems. Strictly necessary Cookies must be present for the Site and Service to provide basic functions that could include signing in. They allow for a user to navigate back and forth between pages without losing their previous actions from the same session.

  • Nonessential Cookie

    If you have consented to their use, Brix and/or its third-party partners may also use nonessential Cookies in connection with the Site and Service, including the following:

    • Functional Cookies – These Cookies enable the Site and Service to provide enhanced functionality and personalization. If you have consented to their use, functional Cookies allow the Site and Service to remember the preferences and choices that you make, including your username, region, and language.
    • Analytic Cookies – We may use analytic Cookies to understand traffic patterns on the Site and Service, to help measure and improve the effectiveness of the Platform and the Site and the Messages and to determine whether such Messages have been opened and links clicked on. These Cookies are used for statistical purposes only. The information these Cookies collect are aggregated and anonymous.     11. Where Is Your Personal Information Stored and Transferred?

    Brix is committed to protecting your Personal Information. Your Personal Information may be held by Brix in locations other than your province, territory, state, or country of residence. Brix may also use the services of subcontractors, clouds providers, consultants, or any other subcontractors (hereinafter collectively referred to as “Subcontractors”) to Process or to share your Personal Information with third parties located elsewhere, including locations other than your province, territory, state, or country of residence. In such a case, Brix will ensure that your Personal Information is transferred to countries that have received an adequacy decision from the competent authority, or that your Personal Information is adequately protected by appropriate technical, organizational, contractual, or other lawful means.

    When our Subcontractors have access to your Personal Information, Brix ensures that such Subcontractors comply with the highest standards of privacy protection and cyber-security, such as having a security certificate like ISO 27001, SOC 2, etc. If you would like to obtain more information on these security measures, please contact Brix as set forth in the “How to contact us ?”   section.

    12. What Are Your Rights?

    • Accessing and Correcting Your Personal Information

      It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes. By law you have the right to request access to and to correct the Personal Information that Brix holds about you. If you want to review, verify, correct, or withdraw consent to the use of your Personal Information you may send us an email as detailed in the “How to contact us ?”   section to request access or to correct any Personal Information that you have provided to us. Brix may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

    • Withdrawing Your Consent

      Where you have provided your consent to the collection, use, and transfer of your Personal Information, you have the legal right to withdraw your consent. To withdraw your consent, if applicable, contact us using the information detailed in the “How to contact us ?”   section, or contact your Organization to whom you have given your consent for the Service. Please note that if you withdraw your consent, we may not be able to provide you, or your Organization, with our Service.

    13. How Do I Make a Complaint?

    Any person wishing to make a complaint concerning our Service, this Privacy Policy, or more specifically, the protection of your Personal Information by Brix, must do so by writing to the contact information detailed in the “How to contact us ?”   section.

    You must provide your name, your contact information, your Organization’s name, if applicable, a telephone number, as well as the subject and reasons for your complaint, giving sufficient details to allow Brix to evaluate the complaint. If the complaint is not specific enough, Brix may request any additional information it deems necessary to assess the complaint.

    Your request may be accepted or denied by Brix or the Organization based on the applicable laws. Brix will take prompt corrective action when it learns of any failure to comply with this Policy. Brix shall not be liable for any indirect, incidental, consequential, or punitive damages relating to this Policy.

    15. Changes to This Policy

    Brix frequently revises this Policy to keep it up to date with applicable legislation and its operations. If material changes are made to the Policy, then update notices (such as online notices or emails) may be used to alert you of such changes. Otherwise, the posting of the revised Policy on the Site or the Service shall be considered sufficient notice to you, and by continuing to use the Site, Service, or the Messages or by submitting Personal Information to us, you are consenting to any changes to our Policy.
